?Shocking.? That?s how California Judge Joan Weber described the actions of prosecutors who had dismissed a gay juror from the recent civil disobedience trial of several same-sex marriage advocates.

The incident was the latest example of potential jurors being removed from trials on the basis of their sexual orientation or gender identity.

Because California is one of the few states where such discrimination is illegal, Weber dismissed the entire jury panel. But in most state and federal courts, it?s legal to remove jurors simply because they are gay, lesbian, bisexual, or transgender.

Attorneys have two tools to create a jury. They can remove a juror for cause if the juror has an obvious bias. Attorneys are also given a limited number of peremptory strikes, which they can use to remove jurors who have no obvious bias.

Generally, attorneys don?t have to state a reason for a peremptory strike. But in the 1986 case of Batson v. Kentucky, the U.S. Supreme Court ruled that jurors could not be dismissed solely because of their race. Federal courts have extended Batson to cover other characteristics ? such as sex ? but have declined to include sexual orientation or gender identity.

In a 2005 appeal of the criminal convictions of two gay men from Minnesota, a defense attorney argued that a gay man was wrongfully dismissed from the jury. The 8th Circuit Court of Appeals ruled that the defense had failed to show discrimination had occurred and that even if it had, the prosecution?s actions likely weren?t illegal. ?[W]e seriously doubt Batson and its progeny extend federal constitutional protection to a venire panel member?s sexual orientation,? wrote the court.

That same year, a separate federal court upheld a transgender juror?s removal, observing that ?no federal law? prevents attorneys from removing ?cross-dressers or transvestites? from juries. (At trial, the prosecutor had explained that ?transsexuals or transvestites ? are more liberal-minded thinking people, tend to associate more with the defendants.?)

And in 2008, a Massachusetts court upheld a prosecutor?s removal of a juror based on the juror?s ?transgendered appearance.?

Even under the Obama administration, the Justice Department has declined to urge judges to bar discrimination against LGBT jurors.

In a case decided last year, a gay defendant challenged the dismissal of a potential juror who had indicated that she had a former ?domestic partner.? Federal prosecutors argued that sexual orientation was not the cause for her dismissal but nonetheless suggested reasons the court should be ?reluctant? to extend Batson to sexual orientation.

During oral arguments, 9th Circuit Judge Marsha Berzon brought up the Obama administration?s recently adopted position that stronger legal protections ? known as ?heightened scrutiny? ? should be applied to sexual orientation. Berzon suggested that this shift might make courts more likely to decide that sexual orientation should be covered under Batson. ?What,? asked Judge Berzon, ?is the government?s ultimate position? on the matter?

?I?m going to frustrate you, your honor,? responded Assistant U.S. Attorney Mark Yohalem, ?because the government?s ultimate position is that it takes no position on that.?

The court declined to decide whether removing jurors based on sexual orientation is legal.

Steve Rothman, a Democratic congressman from New Jersey, is looking to change that. In May, he introduced a bill that would prohibit jury discrimination in federal trials on the basis of gender identity or sexual orientation.

But Rothman?s bill may not become law anytime soon. A spokesperson for Texas Republican Lamar Smith, chair of the House Judiciary Committee ? where the bill currently awaits a hearing ? said that Smith has ?no plans to move the bill at this time.?

Similar legislation was introduced this year on the state level in Minnesota.

?This affects people?s lives,? says Scott Dibble, the state senator who introduced the bill. ?LGBT people provide important perspectives in terms of jury duty.?

Discrimination in jury service, argues Dibble, ?flies in the face of the values that all Americans share.?

According to religious leader Rajan Zed, the manner that they are depicted in the game is insensitive to Hindu worshippers. The game, Zed contends, trivializes these highly revered Hindu deities, who are worshipped in temples and home shrines and not simply reduced to video game characters. Zed is calling for the gods' removal from the game, which is being developed by American developer Hi-Rez Studios.

Smite is described as "online battleground between mythical gods", and it allows players to pick their god and then duke it out in virtual combat.

In an official statement from Zed, the "Hindu statesman" notes that Hindus are, of course, for free speech. The issue here is that Zed believes Smite belittles Hinduism and hurts believers, as faith is something sacred and should be respected.

For some time now, Zed has publically disapproved of how Western popular culture re-appropriates Hindu concepts and gods: whether that be Heidi Klum's Halloween costume, James Cameron's Avatar, or yoga mats.

(AP) ? Among the injustices about the death of Nora Ephron is that she isn't around to tell us about it.

"She was so, so alive," says her friend Carrie Fisher. "It makes no sense to me that she isn't alive anymore."

Ephron, the essayist, author and filmmaker who challenged and thrived in the male-dominated worlds of movies and journalism and was loved, respected and feared for her devastating and diverting wit, died Tuesday in Manhattan. Her publisher, Alfred A. Knopf, announced that she died of leukemia at age 71.

Born into a family of screenwriters, a top journalist in her 20s and 30s, then a best-selling author and successful director, Ephron was among the most quotable and influential writers of her generation. She wrote and directed such favorites as "Julie & Julia" and "Sleepless in Seattle," and her books included the novel "Heartburn," a knockout roman a clef about her marriage to Washington Post reporter Carl Bernstein; and the popular essay collections "I Feel Bad About My Neck" and "I Remember Nothing."

She was tough on others ? Bernstein's marital transgressions were immortalized by the horndog spouse in "Heartburn," a man "capable of having sex with a Venetian blind" ? and relentless about herself. She wrote openly about her difficult childhood, her failed relationships, her doubts about her physical appearance and the hated intrusion of age.

"We all look good for our age. Except for our necks," she wrote in the title piece from "I Feel Bad About My Neck," published in 2006. "Oh, the necks. There are chicken necks. There are turkey gobbler necks. There are elephant necks. There are necks with wattles and necks with creases that are on the verge of becoming wattles. ... According to my dermatologist, the neck starts to go at 43 and that's that."

Even within the smart-talking axis of New York-Washington-Los Angeles, no one bettered Ephron, slender and dark-haired, her bright and pointed smile like a one-liner made flesh. Friends from Mike Nichols and Meryl Streep to Calvin Trillin and Pete Hamill adored her for her wisdom, her loyalty and turns of phrase.

As a screenwriter, Ephron was nominated three times for Academy Awards, for "Silkwood," ''When Harry Met Sally ..." and "Sleepless in Seattle," and was the rare woman to write, direct and produce Hollywood movies. Fisher and Meg Ryan were among the many actresses who said they loved working with Ephron because she understood them so much better than did her male peers.

"I suppose you could say Nora was my ideal," Fisher said. "In a world where we're told that you can't have it all, Nora consistently proved that adage wrong. A writer, director, wife, mother, chef, wit ? there didn't seem to be anything she couldn't do. And not just do it, but excel at it, revolutionize it, set the bar for every other screenwriter, novelist, director."

"Nora Ephron was a journalist-artist who knew what was important to know; how things really worked, what was worthwhile, who was fascinating and why," said "Sleepless in Seattle" star Tom Hanks. "At a dinner table and on a film set she lifted us all with wisdom and wit mixed with love for us and love for life."

The eldest of four children, Ephron was born in New York to screenwriters Harry and Phoebe Ephron, who moved to Beverly Hills, Calif., when she was 4 years old. Words, words, words were the air she breathed. Regular visitors included "Casablanca" co-writer Julius J. Epstein, "Sunset Boulevard" collaborator Charles Brackett, and the team of Albert Hackett and Frances Goodrich, who worked on "The Thin Man" and "It's a Wonderful Life."

Everyone was in movies, "the business."

"People who were not in the business were known as civilians," Ephron wrote in "I Remember Nothing."

If the best humor is born out of sadness, then Ephron was destined for comedy. She was 15, she recalled, when her mother became an alcoholic, finishing off a bottle of scotch a night. Her father, too, was a heavy drinker, "sloppy, sentimental," although "somehow his alcoholism was more benign."

Determined by high school to be a journalist, Ephron graduated from the single-sex Wellesley College in 1962, moved to New York and started out as a "mail girl" and fact checker at Newsweek. A newspaper strike at the end of the year gave her a chance. Victor Navasky, the future editor of The Nation, was then running a satirical magazine called the Monacle. He was working on a parody of the New York Post, "The New York Pest," and asked Ephron for a spoof of Post columnist Leonard Lyons.

She succeeded so well that the newspaper's publisher, Dorothy Schiff, reasoned that anyone who could make fun of the Post could also write for it. Ephron was asked to try out as a reporter. Within a week, she had a permanent job and remained there five years. The Post, she later wrote, was a "terrible paper," and she envied her peers at The New York Times and elsewhere who had more time to work on stories and had better access to people they wanted to interview.

"But the point is this. I was better off ..." she wrote in the introduction to the essay collection "Wallflower at the Orgy, published in 1970. "I learned to go through the clips, find the names of people from the subject's past, hunt them up in old telephone books, track them down, and pull out anecdotes they knew. What I'm saying may seem obvious; but one of the things that stuns me is how seldom reporters do this."

Ephron began writing for Esquire and The New York Times and developed a national following as a throwback to the prime of Dorothy Parker and S.J. Perelman and a worthy peer of such new and hip journalists as Gay Talese and Tom Wolfe. She covered political conventions, the feminist movement and Wellesley, which she labeled a factory for "docile" women. Part of her gift was her fresh takes on such traditional subjects for women as food and fashion, like in the essay "The Food Establishment: Life in the Land of the Rising Souffle (Or Is It the Rising Meringue?)"

"The typical member of the Food Establishment," she wrote, "is given to telling you, apropos of nothing, how many souffles he has been known to make in a short period of time. ... He gossips a good deal about his colleagues, about what they are cooking, writing, and eating; and whom they are talking to, about everything, in fact, except the one thing everyone else in the universe gossips about ? who is sleeping with whom."

By the 1970s, she had met Bernstein, who teamed with fellow Washington Post reporter Bob Woodward on prize-winning coverage of the Watergate scandal that brought down President Nixon. They married in 1976, and had two children, but love soon turned to hate ? and matured into art. Ephron was pregnant with their second child when she learned Bernstein was having an affair, a betrayal that had its rewards, once she stopped crying.

She wrote "Heartburn," later a film starring Streep and Jack Nicholson and directed by Nichols, with whom she collaborated often. The book was so close to her life that Bernstein threatened to sue. Decades later, the memory of the book's birth was easily summoned.

"Yes, totally, completely, absolutely, sitting at the legendary and long-gone Smith Corona electric typewriter that I once had," she told The Associated Press in 2010. "I was working on a screenplay and wrote the first 10 pages of a novel, and I knew the title, knew there were going to be recipes in it. This I remember, exactly where I was, working and knowing, 'Oh, I see, enough time has passed that I'm ready to do this.'"

Another perk from her time with Bernstein: She sussed out that "Deep Throat," the unnamed and unknown Watergate source, was in fact FBI official Mark Felt. She would allege that she told countless people about Felt, who did not acknowledge his role until years later.

Her screenwriting credits included "Heartburn," the nuclear power drama "Silkwood" and the romantic comedy "When Harry Met Sally ..." She twice directed the team of Ryan and Hanks, in "Sleepless in Seattle" and "You've Got Mail," and also worked with John Travolta (in the fantasy "Michael"), Steve Martin ("Mixed Nuts") and Nicole Kidman ("Bewitched").

Ephron had a great nose for nonsense, but was enough a citizen of Hollywood to fall, and fall hard, for a happy ending. "Sleepless in Seattle," in which Ryan and Hanks play long-distance admirers who meet at film's end, was not only a remake of the weeper "An Affair to Remember," but a tribute to how movies might tell us how to live. Ryan and her best pal, played by Rosie O'Donnell, are seen watching "Affair to Remember," which inspires Ryan to suggest to Hanks that they meet ? like Cary Grant and Deborah Kerr ? on top of the Empire State Building, on Valentine's Day.

"That's a chicks' movie," Hanks' character says when he learns about the film's plot.

Ephron was married three times: to Dan Greenburg, Bernstein and, quite happily, to "Wiseguys" author Nicholas Pileggi, whose book was adapted into the Martin Scorsese film "Goodfellas." Sisters Delia, Amy and Hallie Ephron also are writers and Nora and Delia collaborated on such films as "This Is My Life" and "Sleepless in Seattle."

In her essay "The O Word," Nora Ephron anticipated growing too old to make jokes about her age. She would be "really old," beyond sex in a hotel room, or even a frozen custard at Shake Shack. It would be nice if she believed in a higher being, but the phrase "everything happens for a reason" is a sermon that only annoys her.

Ephron wrote of summers in the Hamptons on Long Island when her children were little, of fireworks on the Fourth of July and picnics on the beach. She loved the sound of geese in mid-July ? "one of the things that made the summers out there so magical." As she aged, the geese reminded her that summer will end, and so will everything else.

"I especially began to hate their sound, which was not beating wings ? how could I have ever thought it was? ? but a lot of uneuphonious honks," she writes. "Now we don't go to Long Island in the summer and I don't hear the geese. Sometimes, instead, we go to Los Angeles, where there are hummingbirds, and I love to watch them because they're so busy getting the most out of life."

Spain pays sharply higher rates in debt auction

MADRID (AP) ? Spain's borrowing costs doubled and even tripled in an auction of 3- and 6-month bills, the first sale since the country formally asked the EU for bank bailout money.

The Treasury auctioned ?3.1 billion ($3.9 billion) in the two maturities Tuesday, just above its target range, and demand was strong. But the cost was very high.

The interest rate on 3-month bills was 2.36 percent, compared with 0.85 percent in the last such auction on May 22.

The rate on the 6-month bills was 3.24 percent, from 1.7 percent May 22.

Spain on Monday formally requested the bank bailout but did not specify how much of a ?100 billion fund its eurozone partners have made available.

Also Monday, Moody's made a sweeping downgrade of Spain's troubled banks.

Ah, smartphones -- the delightful little slates carry our contacts, our content -- even our cash, and they still fit right in our pockets. No surprise then, that a lost or stolen phone can be a minor disaster -- or a major security risk (just ask the President). Now that soldiers are packing them to send GPS coordinates or situational images in the field -- on top of using them at home -- DARPA has enlisted security company Invincea to fortify the devices. Its first effort, encrypting OS files and filling the memory of a lost phone with worthless data, has already been deployed to 3,000 troops in Afghanistan. Its next target is to cloister apps into virtual rooms within the OS, locking off access to sensitive parts of the phone like its GPS or contact lists. That would keep any nasty bits of malware from potentially gaining root privileges so soldiers can fight, and Facebook, without compromise.

Mitt Romney Donor Retreat Kicks Off with Tote Bags, Ski Jumpers, and a Roast from Ann

PARK CITY, UTAH- "It will be the happiest day of my life, after the day I got married and the birth of my children."

That's how one donor described what Mitt Romney winning the presidency would mean to him-and he's a Democrat from Los Angeles.

He gave his first ever donation to a candidate just this Fall - a $500 check to Romney - and has since bundled over $200,000 through donations ranging from $1,000 to $2,000 increments for the former governor's presidential campaign, but the donor, who owns shopping centers in California, doesn't want to be publicly identified as a "bundler."

The Los Angeles donor, who once voted for Ronald Reagan, said he cast his ballot for Obama in 2008 because he liked his "rhetoric," but he's since soured on the president whom he called "arrogant" and has turned his full focus on getting Romney elected the next President of the United States.

He said he took time away from his business and family to attend this weekend because he wanted to "network" with other attendees and spend time with Romney himself.

Wealthy donors and bundlers determined to propel Romney to the White House joined a mix of GOP elite, leaders of the party, and members of Romney staff in this postcard perfect resort town for the weekend retreat beginning Friday.

For many, this is a once in a lifetime opportunity to listen to the most famous and influential of the Republican party, hob nob with other wealthy fundraisers and Republican lawmakers, and of course mingle with the presumptive GOP nominee.

There could be as many as 700 attendees gathering at the exclusive retreat over the course of the weekend, and a number of vice presidential contenders will speak and socialize with the donors, including former Minnesota Gov. Tim Pawlenty, Ohio Sen. Rob Portman, Wisconsin Rep. Paul Ryan, Louisiana Gov. Bobby Jindal, Virginia Gov. Bob McDonnell, and South Dakota Sen. John Thune.

As attendees entered the Chateaux at Silver Lake, the host hotel, throughout the sunny afternoon, they were handed a Vineyard Vines tan canvas tote bag with navy piping and the words "Believe in America" stitched on the side. Inside the bag was a blue baseball hat with "Romney" written over a circular American flag and a thick white binder, detailing the weekend's schedule from policy discussions to social events, along with a list of Romney's upcoming events.

Golf carts whipped attendees around the complex and to and from the Stein Eriksen lodge across the street where discussions on healthcare, Israel and the financial services industry were conducted.

The Republican strategist Mary Matalin, Republican National Committee chairman Reince Priebus, and a beaming Tagg Romney, the candidate's eldest son, were seen whizzing by on the carts at various points in the day. The personal touch didn't stop there. As attendees registered, campaign staffers handed everyone a schedule on a lanyard credential, gave directions, and even offered to take suitcases up for those eager to get to the events.

One of the first discussions was a lecture from former Secretary of State James Baker III. Rodger Young and his 26 year old daughter, Lauren, came from New York and Chicago respectively for the retreat (every attendee got a plus one), and he said he was so impressed by Baker he didn't expect to enjoy another one of the events so thoroughly.

Young described the speech as "positive" in tone and although he said Baker did say the country was in "significant trouble" because of the nation's "debt burden," the state of the world "internationally?isn't as bad as you think," specifically pointing out that America has "still by far the strongest military."

Baker scolded the Obama administration for "ignoring any type of bi-partisanship," according to the Youngs. Rodger Young is a business and trial lawyer who lives in both Michigan and New York. Young said he supported Romney in 2008 and originally became involved because he knows Romney's older brother Scott, who was also on hand for the weekend.

He described himself as a donor not a bundler, "yet." Young said the 82-year-old Baker told the crowd he has been around for "1/3 as long as this republic has existed" and despite its current troubles he knows the "resilience of the American people will conquer all."

Lauren praised the campaign's social media efforts, saying she thinks it is effectively targeting Republicans her age.

Friday evening, retreat goers attended a reception at Olympic Park, which sits atop a mountain overlooking picturesque Park City. Romney waved to the small group of press relegated to the bottom of the mountain as his motorcade zoomed up the mountainside.

As young Olympic hopefuls practiced their impressive ski jumping on the green jumps from the 2002 Olympics, which Romney ran, donors arrived amidst heavy security.

Reporters were not allowed into the event, but Olympic athletes did perform their ski jumping for those lucky enough to attend with their plus one.

Two donors who attended the reception said their highlight was Ann Romney's speech where she introduced her family and roasted her sons, four of whom attended.

It all starts up again early Saturday morning with donors expected to hear from Sen. John McCain, former Secretary of State Condoleezza Rice, former Florida Gov. Jeb Bush, Ann Romney, and Karl Rove, former Bush strategist and founder of the GOP superPAC American Crossroads, throughout the day.

Josh Pahigian and Kevin O?Connell have done what many baseball fans only dream about doing, and they?ve done it not just once, but twice. Their fantasy come true? Attending games at all 30 major-league stadiums, and doing it during one whirlwind season.

Their travels form the basis of ?The Ultimate Baseball Road Trip, 2nd Edition,? a nearly 500-page guide that mixes detailed descriptions of each big-league ballpark, team histories, and reviews of food and baseball-related city attractions.

The original opus was published in 2004, when the authors were fresh out of grad school. Even though they both now have families, complicating a reunion tour, their publisher supported revisiting the subject matter in a 2.0 version, partly because eight new ballparks have been built in the interim. And partly because the fan response to the first book, in letters and e-mails, was so encouraging.

Why are fans so enamored of baseball parks? Probably because a sense of place is so integral to the experience of attending a game. ?Stadiums have their own individual character, created by differing field dimensions and outfield walls, which are such a focal point and factor in the outcome of many games. Plus, these days, as the authors underscore, teams strive mightily to enhance the ambience inside and outside parks with everything from kid zones and team museums to fair-like concession areas and water features.

As many as 20 pages are devoted to each ballpark, yet there are no seating diagrams explaining the pros and cons of various sections. The reason is simple. Links are provided to the team websites that carry ticket information and seating charts. In this vein, links are also shared to baseball blogs, Web forums, and the menus of restaurants and bars in ballpark neighborhoods.

The authors clearly love eating and sampling both stadium and nearby restaurant fare. Just how they manage to critique so many options (a dozen or more in each city) is a mystery, but maybe some of the input comes from other fans.

Assessing ballpark hot dogs, of course, is the starting point. L.A.?s famous Dodger Dogs are decreed a bland disappointment. And the Tiger Dogs at Detroit?s Comerica Park are a letdown, too, except that buying one from the operatic vendor in Section 100 makes up for taste shortcomings. The authors find winners along the way, in D.C. and New York, for example, but they consider frankness (pardon the pun) as an important part of their job description.

Mostly, however, they find much to be enthusiastic about in attending games these days. The art and science of ballpark building, it seems, have nearly been perfected, with stadiums sporting superior sight lines, spacious concourses, huge videoboards, and all sorts of entertainment extras and artistic flourishes.

As for where to stay near these ballparks, well, ?Road Trip? doesn?t touch that subject, a surprising omission for a travel guide. But maybe that?s because the authors slept on friends? couches wherever they could, even while traveling on the publisher?s dime and receiving complimentary seats from many teams. Still, given the challenges of finding affordable, convenient accommodations in many cities, some housing tips would be welcome.

That said, the appendix shares fan-friendly itineraries for four sample trips, one of East Coast ballparks dubbed ?Babe Ruth Big Eating Tour? and the others for regional swings through the South, Midwest, and West.

How the authors did their ?work? is interesting and provides one of the funniest sidebars in the book. The episode unfolded during a game at Houston?s Minute Maid Park, where the coauthors had unknowingly secured seats 24 rows behind President H.W. Bush, an Astros fan.

To scout out the ballpark, McConnell left his seat to head for the upper deck to take pictures. Shortly after he took out his camera, however, a security guard approached the author.

Guard: ?How do you feel about our former president??

McConnell: ?Excuse me?

Guard: ?Oh, you heard me. ?

Asked to explain what he was doing taking pictures and occasionally speaking into a microcassette recorder, McConnell described his book project and how the recorder helped him file audio notes for his photo log.

Only after he was released from the interrogation and got back to his seat did things become clear. That?s when stadium P.A. announcer directed the crowd?s attention to the VIP in the box seats.
